1966 Sarawak constitutional crisis Stephen Kalong Ningkan



stephen kalong ningkan tried initiate land reform law allowed natives acquire full title of native customary land. however, alleged backing of federal government, sarawak state assemblymen started pass motion of no confidence against him. prime minister of malaysia, tunku abdul rahman pushed ningkan s resignation.


on 16 june 1966, ningkan ousted when state governor showed him letter of no confidence issued 21 out of 42 legislators , asked ningkan resign chief minister. ningkan refused, saying letters not tantamount vote of no confidence in council negri (now sarawak state legislative assembly). sacked governor reinstated borneo high court on 7 september 1966, saw necessity of formal vote of no confidence.in judgement, justice harley ruled governor can dismiss chief minister when both these conditions satisfied:


(a) chief minister has lost confidence of house, and

(b) chief minister has refused resign , failed advise dissolution.


ningkan tried initiate dissolution of council negri upon reinstatement of chief minister seek fresh mandate voters; malaysian government decided impose state of emergency in sarawak, citing chaos in state. malaysian government amended sarawak constitution give power sarawak governor commence council negri meeting. vote of non-confidence passed on 23 september 1966, , has resulted in removal of ningkan chief minister office second time.
